2.4 Customer account
When you create an account on our website, we collect your name, e-mail address, and a password (which is stored in encrypted/hashed form and is not accessible to us). We share your name, address, e-mail, telephone number, order number, and delivery preferences with our chosen delivery providers solely for the purpose of fulfilling your order. Legal basis: Article 6(1)(b) GDPR.
We also use third-party data processors for website technical operations, logistics, newsletter distribution, and targeted marketing. All data processors act under our documented instructions pursuant to written data processing agreements compliant with Article 28 GDPR and may not use data for any purpose beyond fulfilling their agreement with us.
Where data is transferred outside the UK/EEA (for example, to Google LLC or Meta Platforms, Inc.), such transfers are carried out in accordance with Chapter V GDPR using appropriate safeguards, including Standard Contractual Clauses (SCCs) adopted by the European Commission, and/or where applicable the EU-U.S. Data Privacy Framework. Part C – Sales Conditions
The following conditions apply to all deliveries from Henrik Vibskov Boutique, MMTHMSIIH APS, CVR no. 29840741, Gammel Mønt 14, 1117 Copenhagen K, Denmark, to customers ordering via www.henrikvibskovboutique.com or any other designated Henrik Vibskov Boutique online sales channel.
Formation of Contract
Henrik Vibskov Boutique reserves the right to correct prices that have been incorrectly stated. A binding contract is formed only when your order has been confirmed by Henrik Vibskov Boutique. An order confirmation will be sent to you by e-mail once your order has been accepted and dispatched. An automated receipt issued immediately upon submission of your order does not constitute an order confirmation. Purchases through our online shop are available to private consumers only; we do not sell to trade customers via the webshop.
Prices and Payment
Prices are displayed and can be paid in your local currency at checkout, with support for a wide range of currencies worldwide. For customers within the EU, the VAT rate applicable in your country of residence is applied at checkout. For customers outside the EU, 0% VAT is applied.
All orders are dispatched from Denmark. We ship on a Delivered Duty Paid (DDP) basis worldwide, meaning all customs duties and import taxes are included in the price you pay at checkout. You will not receive any additional charges upon delivery.
Please note that customers in certain Asian countries, including Taiwan, Indonesia, Thailand, China, and India, may be subject to additional local import duties and taxes upon delivery. These fees are determined by local customs authorities, are outside of our control, and are not covered by us. If you are unsure whether this applies to your country, we recommend checking with your local customs authority before placing your order.
We reserve the right to amend prices, fees, and other charges at any time due to changes in VAT rates, regulatory levies, or general retail price movements. If you pay by instalments, any changes to fees will be communicated with reasonable notice.
Please note that some banks apply foreign transaction fees to purchases made in our online shop. Such fees are charged by your bank; Henrik Vibskov Boutique is unable to refund them. Please contact your bank for details.
We accept the following payment methods: Visa, Mastercard, American Express, Maestro, UnionPay, Dankort, MobilePay, Bancontact, iDEAL, Klarna, Apple Pay, Google Pay, and Shop Pay. Your payment is charged once your order has been dispatched.
Delivery
Henrik Vibskov Boutique reserves the right to decline orders and is not obliged to deliver goods that are out of stock. Under normal circumstances, orders are processed and dispatched within 2 business days. Delivery times are estimates only. Longer delivery times may apply during sale periods. Henrik Vibskov Boutique cannot be held responsible for delays caused by customs clearance or payment processing.
Right of Withdrawal (Cancellation Rights)
In accordance with the EU Consumer Rights Directive (Directive 2011/83/EU) as implemented in Danish law, you have the right to withdraw from your purchase without giving reasons.
- You have 14 days to notify us of your intention to withdraw, and a further 14 days from notification to return the goods.
- The withdrawal period begins on the date you (or a third party you nominate) take physical possession of the goods.
- Goods should be returned unused, in their original condition and packaging. If goods are returned in a used or damaged condition, we reserve the right to deduct an amount reflecting the diminished value from your refund.
- If we have failed to provide you with the required statutory information about your right of withdrawal, the withdrawal period is extended to 12 months from delivery.
- Where the withdrawal period expires on a Saturday, Sunday, or public holiday, the deadline is extended to the next working day.
- If you exercise your right of withdrawal, we will refund the standard delivery costs along with the price of the goods.
How to withdraw:
You may exercise your right of withdrawal by notifying us in writing (e.g. by e-mail to contact@henrikvibskov.com) before the withdrawal period expires. You may also use the standard EU withdrawal form, although this is not mandatory.
The goods must be returned to us at: Henrik Vibskov Boutique, Gammel Mønt 14, 1117 Copenhagen K, Denmark, before the expiry of the return period. A postal or courier receipt confirming timely dispatch is sufficient proof of compliance.
Unless otherwise agreed, you are responsible for the cost of return postage. If we have made a substitute delivery because the original product was unavailable, we will cover the return cost.
As an alternative to active return, you may also exercise your right of withdrawal by refusing delivery or failing to collect the parcel from your local collection point.
Refunds
It is a general condition that goods are returned in the same condition and quantity as delivered. Goods that have been materially altered or damaged may result in a reduction of the refund.
We will issue your refund using the same payment method you used for the original purchase. We withhold the refund until we have received the returned goods.
Refunds will be made as soon as possible after receiving your package and within 8 business days. You will receive a confirmation via email once your return is processed, and you will be able to see the refund in your bank account or credit card statement up to 30 days after the refund is issued.
For purchases made via Klarna, refund and instalment terms are subject to Klarna's own terms and conditions.
Complaints and Quality Guarantee
If a product is damaged in transit, has a manufacturing defect, or develops a fault within 24 months of purchase, please contact our customer service as soon as reasonably possible at contact@henrikvibskov.com.
Any complaint must be made within a reasonable time after the defect is discovered or ought to have been discovered, and in no circumstances later than 2 years from the date of purchase. If your complaint is valid, you may be entitled to repair, replacement, a price reduction, or a full refund, depending on the circumstances and applicable Danish consumer law.
If you are dissatisfied with the outcome of a complaint, you may submit a complaint to the Danish Centre for Complaint Resolution (Center for Klageloesning), Naeringsgade 10, 8000 Aarhus C (www.forbrug.dk), or, if you are based in another EU member state, via the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
Liability
Henrik Vibskov Boutique is not liable for delays or non-performance caused by circumstances beyond our reasonable control (force majeure), including but not limited to natural disasters, strikes, government actions, or infrastructure failures. During such an event, our obligations are suspended for the duration.
Save in cases of fraud, wilful misconduct, or gross negligence, and save as otherwise provided for mandatory consumer protection law, our total liability to you for any claim arising from a purchase shall not exceed the price paid for the product giving rise to the dispute. This limitation applies regardless of the basis of the claim.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law.
Governing Law and Jurisdiction
These Terms & Conditions are governed by Danish law. Any disputes shall be subject to the jurisdiction of the Danish courts, save that consumers resident in another EU member state retain the right to bring proceedings before the courts of their country of domicile.
